Summary report on Kosovo’s public administration reform

For Kosovo as a new state, an efficient and accountable public administration is a crucial portion of democratic governance and state functioning. Reforming and improving the functioning of public administration has been a key issue in the EU-Kosovo relations in the recent years.

This summary report aims to reflect and discuss on the situation of the public administration reforms in Kosovo in the recent years, through focusing on the documents and strategies that have been approved during this period. Furthermore, the report will analyze the key achievements and implementation level of PAR thus far and suggest recommendations for the new Government of Kosovo to implement, based on the main challenges that need to be addressed.

This report has been prepared as part of the project "Strengthening Transparency and Accountability for Reforms" implemented by PIPS and Lëvizja FOL, and supported by the Embassy of the Kingdom of the Netherlands in Kosovo.

Real Estate in Kosovo - Opening the market with the EU

Foreigners in Kosovo can only own real estate if they acquire ownership through inheritance. Given Kosovo's aim to join the European Union(EU), this situation is changing. The Stabilization and Association Agreement (SAA) between Kosovo and the EU foresees the opening of the Kosovo real estate market to citizens and companies of EU member states.

Despite the clear provisions of the SAA in this regard, in practice this market opening is challenged in principle by the current legal framework for property rights and their implementation in Kosovo.

This study analyzes the legal framework, challenges and expected impact, and provides recommendations.

Reform of rationalization of agencies and regulators in Kosovo - Second phase

On the one hand, it assesses the state of play regarding the agencies of this phase. On the other hand, the paper discusses possible options for their rationalisation.

Monitoring Report - Action Plan for Rationalization of Executive Agencies and Regulators

The Action Plan for Rationalization of Independent Agencies was approved by the Government of Kosovo in 2017. This document is an obligation arising from the European Reform Agenda (ERA), a document derived from Kosovo's Stabilization and Association Agreement (SAA) with the EU. Also the SBS contract, the Financial Sector Support Agreement (SBS) between the Government and the European Commission through which the EC conditions the transfer of financial support tranches with progress throughout the rationalization process during 2018 and 2019 with the achievement of the objectives of this plan.

Rationalization of executive agencies and regulators in Kosovo

The reform for rationalization of executive agencies and regulators started in 2015, as part of the reform dialogue in the field of public administration between Kosovo and the European Union.
The policy framework for implementing the rationalization of executive agencies and regulators foresees its completion by the end of 2021. It is expected to affect over 60 institutions, most of which exercise executive functions.
To contribute to the implementation of this reform, this policy analysis addresses this reform in two dimensions, the context and framework of this reform, and its implementation.
This analysis concludes with the main conclusions and a number of recommendations for the implementation of the reform.

ERA Monitoring Report 2018

This monitoring report reviews the achievements of the institutions throughout 2018, nonetheless, we have published monitoring reports for the six- and nine-month monitoring period. In order to give a clear picture of the state and process of ERA implementation, this study focuses on elaborating the methodology and results of the monitoring process, analyzing the current state of the achievements and shortcomings of institutions, as well as providing conclusions and recommendations.

European Reform Agenda Monitoring Report January - September 2018

This monitoring report aims to assess the achievements and setbacks as part of the implementation of the European Reform Agenda. It is focused on the evaluation of Kosovo institutions in the implementation and enforcement of ERA measures and actions. The three organizations involved in preparing this report: PIPS, GLPS and GAP Institute, have continuously monitored the process intensively in the respective ministries and have summarized their assessments which are identified in this report. This paper fully shows all the progress and stagnation by the Government of Kosovo during 2018. Most importantly, this paper serves as a mechanism for raising awareness of the Government and citizens of the Republic of Kosovo in relation to European integration and the performance of state institutions.
